These Terms & Conditions (“Terms”) govern the photography and videography services, packages, and payment plans offered by Nightshade and Ivory (“we,” “us,” or “our”). By booking a package, selecting a payment plan, or providing a payment method, you (“you” or the “client”) agree to these Terms. Please read them carefully, especially the sections on automatic payments and cancellations.
Booking & Deposit
A signed photography agreement and a non-refundable retainer (deposit) of $250 are required to officially reserve your date. The retainer is applied toward the total cost of your selected package and secures your date on our calendar. Your session or wedding date is reserved exclusively for you once your booking is confirmed.
The final balance is due before services are rendered, as outlined in your signed agreement.
The booking retainer is non-refundable under all circumstances. Because reserving your date means we turn away other potential clients for that date, the retainer compensates us for that commitment and is never returned, even if you cancel.
Payment Plans & Automatic Payments
We offer the option to pay in full or to split your package into equal monthly installments (3, 6, or 12 months). When you choose a payment plan and provide a payment method, automatic payments are turned on by default for your convenience so that no payment is ever missed.
How automatic payments work: When you set up your plan, you enter your card once and expressly authorize us to automatically charge that card on file for each scheduled payment on its due date, for the full duration of your plan, until your balance is paid in full. Your card details are stored securely by our payment processor, Stripe — we never see or store your full card number.
Amounts and dates: Before you confirm, you will be shown the exact amount of each payment and the date it will be charged. Payments are equal monthly installments beginning on your booking date.
Reminders and receipts: We will email you a reminder before each automatic charge, and a receipt after each successful payment, at the email address associated with your account.
Failed payments: If an automatic charge is declined (for example, due to an expired card or insufficient funds), we may retry the charge. If it continues to fail, automatic payments may be paused and you will be responsible for making the payment manually through your client portal. You remain responsible for the full balance of your package regardless of payment method.
Managing or Cancelling Automatic Payments
You are always in control. You may turn off automatic payments at any time — there is no penalty for doing so. To cancel automatic payments:
- Log in to your client portal.
- Go to the Payments page.
- Find the Automatic Payments section and switch the toggle to off.
Turning off automatic payments stops future automatic charges immediately. Any payments already processed are not reversed. When automatic payments are off, you remain responsible for making each scheduled payment manually, by the due date, using the “Pay Now” button in your portal. You can turn automatic payments back on at any time. Cancelling automatic payments does not cancel your booking or reduce the total amount you owe.
Travel
Travel within Arizona is included unless otherwise stated. Additional travel fees may apply for locations outside the included service area. Any applicable travel fees will be outlined in your agreement.
Galleries, Delivery & Editing
Gallery delivery times vary depending on the type of session. Estimated delivery timelines will be provided in your agreement.
Each image is edited in Nightshade and Ivory’s signature artistic style. Requests for extensive editing beyond that artistic style may be subject to additional fees.
Print Release & Image Usage
Clients receive a personal print release for their delivered images. Nightshade and Ivory retains the copyright to all photographs.
Images may be used by Nightshade and Ivory for portfolio, website, and marketing purposes unless otherwise agreed upon in writing.
Cancellations, Forfeiture & No Refunds
Please read this section carefully.
All payments are non-refundable. If you cancel your booking for any reason, all amounts already paid are forfeited and will not be refunded.
Cancellation before the deposit is fully paid: If you cancel and have not fully paid the required deposit, you forfeit all amounts paid to date, and no refund of any kind will be issued. Any remaining unpaid portion of the deposit may still be owed.
Cancellation after making payments: If you cancel after making one or more payments, all amounts paid are forfeited and non-refundable. We do not provide partial or full refunds of installments already collected.
No refunds: Because we reserve your date exclusively and begin preparation and planning upon booking, all sales are final and all payments (including deposits and installments) are non-refundable under all circumstances.
Rescheduling: Rescheduling and cancellations are subject to the terms outlined in your signed photography agreement. To request a change to your date, please contact us as early as possible.
Turning off automatic payments is not the same as cancelling your booking. To discuss cancelling a booking, please contact us directly using the details below.
